Give us an Incident Description: I was lawfully walking in the road per Vehicle Code § 21955(b)(1), AB 2147, Freedom to Walk Act. He arrested me after I refused ID.

What rules / offences did the player break: FRP/NITRP/false arrest

How long do you think the player be punished for: at least a multi-day ban since he showed ZERO intent to understand CA traffic law. he made zero attempt to verify the info i gave him and ignored traffic law. he violated multiple constitutional rights, clearly has no intent to RP. if not a multi-day ban then he should be locked out of LEO teams for a few days.

Time of Occurrence: ~1:15 PM CST
Additional members involved/witnessing: N/A

Before you say "oh well every little bit of ca law doesn't apply" this is EXTREMELY basic traffic law. Almost as basic knowledge as right on red is.

“…shall not stop a pedestrian for a violation unless a reasonably careful person would realize there is an immediate danger of a collision…”

i would also like the SBI and the partner to receive a warning since they don't know what they're talking about. SBI lied about what is and isn't jaywalking, partner assisted the unlawful arrest.

"Assembly Bill Number 2147

California Assembly Bill Number 2147 makes changes to California Vehicle Code section 21456. Specifically, it prohibits peace officers from stopping a pedestrian for jaywalking unless the jaywalking causes immediate danger." from the source above

Here's a much more simplified breakdown of what and why.

What I did was lawful, what the officer did wasn’t, because:

  • My walking wasn’t a violation. I was in a business/residential area, using the road only when it was basically empty and always stepping out of the way long before any car was in real danger. Under California’s pedestrian law plus the Freedom to Walk Act (AB 2147), an officer “shall not stop” a pedestrian for a roadway / jaywalking violation unless a reasonably careful person would see an immediate danger of a collision. There was no such danger in my scenario, so there was no lawful basis to stop or detain me in the first place.

  • Refusing ID was legal; arresting me for it wasn’t. California is not a stop-and-ID state for pedestrians: if you’re not driving and not under lawful arrest, you generally don’t have to show ID just because an officer asks, and simple refusal to identify yourself in a detention is not, by itself, a crime. The officer ignored those limits, treated a non-violation as a detention, demanded ID with no legal basis, and then arrested me when I asserted a right I actually had.

I followed the law; the cop made up a penalty that doesn’t exist.

(1) Definition. For the purposes of this section, “jaywalking” means the act of a pedestrian crossing a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection, in violation of any traffic control signal or pedestrian control device, or otherwise in disregard of vehicular right-of-way.

Void/outdated due to the freedom to walk act.

Nevermind, sorry. I was under a different impression.

I thought this game was based off CA law and had no indication there was a separate legal system.
