Incident Description*:While I was conducting patrol as VHP, I briefly lost control of my vehicle and crashed into a light pole. As I was beginning to pull over to start a report and call a supervisor on the event, I was stopped by an unmarked Law Enforcement vehicle. The driver of the vehicle and one other occupant exited the vehicle and demanded my ID, which I provided (without identifying themselves). ALWAYZJAXALT then immediately issued me a summons for reckless driving and excessive speeding without returning to his vehicle to run my information, ask me any questions about the situation, or provide me with the ample time to ask any questions regarding the summons. ALWAYZJAXALT then returned to his vehicle (along with his unk passenger), turned off his emergency lighting system, and began to back up to drive away. I then exited my vehicle so I could ask about why I had been cited for 20+ over the speed limit, as I had not been speeding (I understood reckless driving due to the fact that I damaged public property). [AT THIS POINT THE CLIP BEGINS] After asking, "I wasn't speeding[?]," ALWAYZJAXALT then exited his vehicle (along with his unknown passenger) with their firearms drawn, 1 handgun and 1 rifle. I exclaimed "WHAT ARE YOU DOING," and they said that I had "gotten out during a traffic stop" (even though they had begun to leave and had their emergency lights off). They informed me not to reach, so i did not pull anything out of my inventory, then one of them yelled "HES REACHING," and, without giving me a chance to respond, shot me. Both individuals than "dead-checked" me while i was on the ground bleeding out. Following my death, I checked the citation that i received and noted that the summary stated "speed, reckless." No further details were provided, in addition to how they tracked my speed to determine that I was speeding. NOTE: I was in a clearly marked VHP cruiser and had the proper uniform on to identify myself as VHP. I also did not pull out any weapons or reach in any way to lead them to conclude that I was "reaching". I recognize that I probably did not need to leave my vehicle, but since I believed the traffic stop was over (due to the previous stated observations) and I had questions to ask, I decided it would be best to ask before they left. I do recognize that I made a mistake by hitting the pole, but I believe that their response was escalated beyond the scope of the use of force continuum. Furthermore, I believe that their actions directly violated department SOP, state/federal law, and React studios guidelines. As a Chief of Police (rank was stated on the summons), ALWAYZJAXALT should have the experience necessary to understand all of the terms stated above. In addition, he should have known how to properly conduct a traffic stop, de-escalate situations, properly write citations, be able to articulate the reasons for the stop, be able to explain his Reasonable Articulable Suspicion (RAS) and Probable Cause (PC) in his report, and follow guidelines set by React Studios.
